This paper highlights the need to reflect on the media way how criminal laws are developed in Colombia without considering public policies tending, mainly to the primary prevention of crime, but rather goes directly to criminal repression without taking into account the Education of children and adolescents as a fundamental tool to eradicate it or at least, to carry it to its minimum expression. Therefore, the Colombian State by means of Criminal Law materializes a repressive norm and does not use it as the ultima ratio.
